PackScout Data & Commercial Use Policy

1What This Policy Covers

PackScout compiles publicly available and licensed information concerning repacks, pack-opening products, and Third-Party Platforms and applies its own methodologies, calculations, organization, selection, normalization, analysis, and presentation to produce expected value ("EV") calculations, valuations, rankings, comparisons, normalized odds, confidence indicators, and related derived metrics and commentary (collectively, "PackScout Data").

PackScout does not claim ownership of underlying facts or information originating from a Third-Party Platform merely because those facts are displayed through the Service. A Third-Party Platform's own stated prices, odds, product information, trademarks, and other third-party materials remain subject to the rights of their respective owners.

PackScout retains all rights available to it under applicable law in its proprietary software, methodology, original content, calculations and analytical outputs to the extent protectable, and in the selection, coordination, arrangement, compilation, formatting, and presentation of PackScout Data and the Service.

Nothing in this Policy grants any right to access, collect, reproduce, republish, commercially exploit, or otherwise use PackScout Data except as expressly stated below.

2Limited Personal and Editorial Reference Use

Subject to this Policy and the Terms of Service, you may view PackScout Data for your own personal, non-commercial use.

You may also reproduce a limited and reasonable excerpt of PackScout Data for ordinary editorial, journalistic, commentary, or personal social-media purposes, such as citing a specific PackScout figure or sharing a screenshot of an individual PackScout result, provided that the use:

• clearly identifies PackScout as the source and, where reasonably possible, links to packscout.com or the relevant PackScout page;
• is limited in scope and does not reproduce a material portion of a page, dataset, ranking, catalog, or collection;
• is not systematic, repeated, automated, or designed to substitute for use of the Service;
• does not imply PackScout's endorsement, sponsorship, approval, or affiliation; and
• is not incorporated into a competing or commercial data, analytics, comparison, EV, odds, or repack product.

This limited permission is revocable and does not apply to any activity prohibited by Section 3.

3Prohibited Access and Use

Except with PackScout's prior written authorization or under a separate written license, you may not, directly or indirectly:

• scrape, crawl, spider, harvest, mine, index, extract, download, query, copy, or otherwise collect PackScout Data or other Service content through automated means;
• use bots, scripts, browser extensions, headless browsers, automated agents, AI agents, software tools, or similar technology to access, monitor, collect, or extract content from the Service;
• systematically collect, compile, record, reproduce, photograph, screenshot, transcribe, or archive PackScout Data by manual means;
• use multiple accounts, IP addresses, proxies, VPNs, rotating identifiers, third parties, or other means to avoid or circumvent rate limits, access controls, bot detection, blocks, or other restrictions;
• republish, redistribute, mirror, syndicate, transmit, sell, license, sublicense, expose, or make available PackScout Data, in whole or in material part, through any website, application, bot, API, feed, database, spreadsheet, dataset, model, service, or product;
• use PackScout Data to create, populate, support, benchmark, validate, improve, or operate a competing or substantially similar EV, odds, repack-analysis, comparison, collectibles-analytics, pricing, or data product;
• use PackScout Data or Service content to train, fine-tune, ground, retrieve for, test, benchmark, evaluate, or improve any artificial intelligence, machine-learning, statistical, or automated model or system;
• combine PackScout Data with other information for resale, licensing, commercial distribution, or provision of a commercial data service;
• use PackScout Data for commercial competitive intelligence or systematic internal business analysis by a competing or adjacent business;
• reverse engineer, decompile, disassemble, decode, derive, infer, reconstruct, or attempt to discover PackScout's non-public methodology, formulas, algorithms, source code, data structures, or technical systems;
• remove, obscure, modify, or falsify PackScout attribution, copyright notices, watermarks, source labels, or other proprietary notices;
• facilitate, direct, encourage, procure, or assist another person or entity in engaging in prohibited activity; or
• access or use the Service in a manner that exceeds the limited authorization granted by the Terms of Service and this Policy.

For avoidance of doubt, publicly accessible portions of the Service are not offered as an unrestricted data source. PackScout does not authorize access to the Service for scraping, systematic extraction, competitive data collection, dataset creation, model training, commercial republication, or reverse engineering.

A failure by technical measures to block a particular method of access does not constitute permission or authorization to use that method.

4No Implied API, Data License, or Bulk Access

PackScout does not currently offer a self-service API, bulk export, or general data license.

The ability to view information through the ordinary user interface does not grant a license or authorization to retrieve the same information programmatically, systematically, in bulk, or for commercial use.

Any programmatic, bulk, commercial, or licensed use of PackScout Data requires PackScout's prior written authorization and may be subject to a separate agreement, fees, usage limitations, attribution requirements, security requirements, or other conditions.

5Technical Measures and Enforcement

PackScout may monitor use of the Service for activity that appears inconsistent with this Policy or the Terms of Service.

To protect the Service and PackScout Data, we may use technical and operational measures including rate limits, bot detection, CAPTCHAs, authentication requirements, request throttling, IP or account blocking, access revocation, and other measures.

If we reasonably believe that you have violated this Policy, we may, to the extent permitted by applicable law:

• suspend, restrict, or terminate your access to the Service;
• block accounts, IP addresses, devices, credentials, or other identifiers associated with prohibited activity;
• demand that collection cease and that unauthorized copies or derivative datasets be deleted;
• send cease-and-desist, preservation, removal, or takedown demands;
• seek temporary, preliminary, or permanent injunctive or equitable relief;
• pursue damages or other relief available for breach of contract, infringement, misappropriation, unfair competition, unjust enrichment, interference, circumvention, or other applicable claims; and
• exercise any other rights or remedies available under contract or applicable law.

PackScout's decision not to enforce a restriction in one instance does not waive its right to enforce that restriction later.

6Reservation of Rights

Except for the limited permission expressly granted in Section 2, no license or right is granted by implication, estoppel, course of dealing, or otherwise.

PackScout reserves all rights not expressly granted in this Policy or the Terms of Service.

Nothing in this Policy is intended to restrict rights that cannot lawfully be restricted, including any rights that apply notwithstanding contractual restrictions under applicable law.

7Data Accuracy and No Warranty

PackScout Data is provided "as is" and "as available." Third-Party Platforms may change odds, prices, inventory, product information, or availability without notifying PackScout, and PackScout Data may be incomplete, inaccurate, delayed, stale, or affected by methodological, technical, or human error.

PackScout EV figures, valuations, rankings, comparisons, and related metrics may incorporate estimates, assumptions, ranges, normalization techniques, valuation judgments, historical information, and incomplete or unavailable inputs. Different reasonable methodologies may produce materially different results.

Nothing in this Policy constitutes financial, investment, gambling, legal, or other professional advice. The disclaimers and limitations of liability contained in the Terms of Service apply to PackScout Data and to all use of the Service.

8Requesting Permission or Licensed Access

If you are a journalist, researcher, business, or other organization seeking to use PackScout Data beyond the limited permission in Section 2, including for bulk, programmatic, commercial, research, or licensed access, contact us at hello@packscout.com and describe your proposed use.

PackScout may approve or reject any request in its discretion. Any approval must be in writing and may be subject to a separate agreement, fees, restrictions, attribution requirements, or other conditions.

9Changes to This Policy

We may update this Policy from time to time. Material changes will be reflected by updating the "Last Updated" date and, where appropriate or legally required, providing additional notice.

Continued access to or use of the Service after a revised Policy becomes effective constitutes acceptance of the revised Policy to the extent permitted by applicable law.
