PackScout Terms of Service

Last Updated: September 15, 2026

Please read these Terms of Service ("Terms") carefully before using PackScout. These Terms constitute a legally binding agreement between you ("you" or "User") and PackScout LLC, a Delaware limited liability company ("PackScout," "we," "us," or "our"), governing your access to and use of the website located at packscout.com and any related applications, tools, features, or services (collectively, the "Service").

By accessing or using the Service, creating an account, or otherwise indicating your acceptance of these Terms, you agree to be bound by them. If you do not agree, do not access or use the Service.

These Terms contain an agreement to resolve most disputes through binding individual arbitration and include a class action waiver. Please review Section 14 carefully.

1What PackScout Is

PackScout is an independent analytics and information platform. We aggregate, calculate, estimate, and display expected value ("EV") metrics, odds information, pricing and valuation data, rankings, comparisons, and related statistics concerning chance-based "repack" and pack-opening products offered by third-party platforms (each, a "Third-Party Platform").

Third-Party Platforms currently covered may include Collector Crypt, Courtyard, Beezie, ClutchPacks, GameStop Power Packs, Phygitals, Stadium Vault, Trove.xyz, and others that we may add or remove at any time.

PackScout does not sell, distribute, operate, host, fulfill, or determine the contents or outcomes of repacks, packs, cards, or other physical or digital collectible products. We do not process payments for those products, take custody of them, determine their odds or outcomes, or control whether a Third-Party Platform fulfills a purchase.

Any purchase you make from a Third-Party Platform is a transaction solely between you and that Third-Party Platform and is subject to that platform's terms, policies, representations, and practices.

Unless expressly stated otherwise, PackScout is not affiliated with, endorsed by, sponsored by, or operated by any Third-Party Platform it covers. Third-party trademarks, product names, and platform names are the property of their respective owners and are used for identification, informational, and comparison purposes.

2Chance-Based Products and Assumption of Risk

Repacks and other chance-based products involve substantial uncertainty and the risk of financial loss. The value of what you receive may be substantially less than the amount you spend.

PackScout provides information and analytics intended to help users better understand these products. PackScout does not guarantee that you will receive value equal to or greater than the purchase price of any product, even when PackScout displays a positive EV, favorable ranking, favorable comparison, or other metric for that product.

EV is a statistical estimate across possible outcomes. It does not predict the outcome of any individual purchase or series of purchases. A product with a positive estimated EV may still result in a substantial or complete economic loss for an individual purchaser.

You are solely responsible for deciding whether to purchase any product from a Third-Party Platform, how much to spend, and whether such purchases are appropriate and lawful for you.

By using PackScout in connection with a purchase, you acknowledge and voluntarily assume the risks associated with chance-based products, including the risk that the value you receive may be materially less than the amount you spend.

If gambling or chance-based purchasing is causing you problems, stop purchasing and seek help. You can call or text 1-800-GAMBLER or visit the National Council on Problem Gambling website.

3Informational Purposes Only; No Advice or Recommendation

The Service is provided for informational and entertainment purposes only.

Nothing on PackScout constitutes financial, investment, legal, tax, gambling, or other professional advice. Nothing displayed on the Service constitutes a guarantee or promise regarding the value or outcome of any product.

Unless expressly identified as such, rankings, sorting, badges, comparisons, featured products, EV figures, valuations, and other metrics displayed by PackScout should not be interpreted as a recommendation or instruction to purchase any particular product.

Every purchase decision you make is your own and is made at your own risk.

4EV, Valuation, Odds, and Data Disclaimer

PackScout works to make its calculations and data useful and accurate, but all analytics displayed through the Service are subject to limitations.

PackScout EV figures, valuations, rankings, comparisons, odds calculations, confidence indicators, and other metrics are estimates and analytical outputs. Depending on the product and available information, they may incorporate assumptions, estimates, valuation judgments, normalization techniques, ranges, historical sales information, third-party data, incomplete information, unavailable information, or other methodological choices.

Reasonable alternative methodologies or assumptions may produce materially different results.

Third-Party Platforms may also change products, inventory, odds, pricing, valuations, availability, terms, or other information at any time and without notice to PackScout. Information collected or displayed by PackScout may therefore be incomplete, inaccurate, delayed, stale, incorrectly interpreted, or affected by technical or human error.

PACKSCOUT DOES NOT WARRANT OR GUARANTEE THAT ANY EV FIGURE, VALUATION, RANKING, ODDS CALCULATION, PRICE, INVENTORY FIGURE, PRODUCT DESCRIPTION, OR OTHER INFORMATION DISPLAYED THROUGH THE SERVICE IS ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR MAKING A PURCHASE DECISION.

YOU SHOULD NOT RELY ON ANY PACKSCOUT EV, RANKING, VALUATION, ODDS CALCULATION, CONFIDENCE INDICATOR, OR OTHER METRIC AS A GUARANTEE OR PREDICTION OF WHAT YOU WILL RECEIVE OR OF THE ECONOMIC RESULT OF ANY PURCHASE.

Before making a purchase, you should independently verify the product's current price, odds, inventory, terms, disclosures, and other relevant information directly with the applicable Third-Party Platform.

PackScout is not responsible for losses arising from discrepancies between information displayed on PackScout and information or outcomes on a Third-Party Platform.

5Affiliate Relationships and Disclosures

PackScout participates or may participate in affiliate, referral, sponsorship, or similar commercial relationships with some of the Third-Party Platforms featured on the Service.

If you click a link from PackScout to a Third-Party Platform and make a purchase or take another qualifying action, PackScout may receive a commission, referral fee, or other compensation at no additional cost to you.

Affiliate relationships do not alter PackScout's underlying EV methodology or calculations. However, you should be aware that PackScout may have a financial relationship with a Third-Party Platform whose products appear on the Service.

Where required by applicable law or platform policy, affiliate or sponsored relationships will be disclosed.

6Eligibility

You must be at least 18 years old to use the Service.

By accessing or using the Service, you represent and warrant that you are at least 18 years old, have the legal capacity to enter into these Terms, and may lawfully use the Service in your jurisdiction.

You are responsible for ensuring that your use of the Service and any purchases you make from Third-Party Platforms comply with applicable laws and regulations, including laws concerning chance-based purchases, sweepstakes, gambling-adjacent products, and collectibles.

PackScout does not represent or warrant that any product offered by a Third-Party Platform is lawful or available in your jurisdiction.

7Accounts

Certain features may require you to create an account, including through email or a third-party sign-in provider such as Google or Apple.

You agree to provide accurate information and to keep your login credentials secure and confidential. You are responsible for activity occurring through your account.

You must promptly notify PackScout at hello@packscout.com if you know or suspect that your account has been accessed without authorization.

We may suspend, restrict, or terminate accounts that violate these Terms or that we reasonably believe present a security, fraud, abuse, or legal risk.

8Acceptable Use and Data Restrictions

Your access to and use of the Service is expressly conditioned on compliance with these Terms and PackScout's Data & Commercial Use Policy, which is incorporated into these Terms by reference.

Except as expressly permitted by that Policy or by PackScout in a separate written agreement, you may not:

  • scrape, crawl, spider, harvest, mine, index, extract, download, or systematically collect data or content from the Service, whether through automated or manual means;
  • use bots, scripts, browser extensions, AI agents, automated systems, or similar technology to access or collect content from the Service;
  • republish, redistribute, mirror, syndicate, sell, license, or incorporate PackScout data, calculations, rankings, or content into another website, application, dataset, feed, model, service, or product;
  • systematically collect, compile, reproduce, or archive PackScout data over time;
  • use PackScout data or content to train, fine-tune, test, benchmark, evaluate, or improve any model, database, product, or service;
  • use PackScout data to create, support, or improve a competing or substantially similar EV, odds, repack-analysis, comparison, or collectibles-analytics product;
  • reverse engineer or attempt to derive PackScout's methodology, algorithms, formulas, software, source code, or non-public systems;
  • circumvent rate limits, bot detection, access restrictions, authentication controls, or other technical measures;
  • interfere with or disrupt the integrity, security, or performance of the Service;
  • access the Service using false identities or deceptive means for the purpose of avoiding restrictions or enforcement;
  • use the Service for an unlawful purpose; or
  • otherwise commercially exploit PackScout data or content except pursuant to PackScout's prior written authorization.

PackScout does not authorize access to the Service for prohibited scraping, systematic extraction, competitive data collection, dataset creation, model training, reverse engineering, or commercial republication.

We may use technical measures to detect and prevent prohibited activity, including rate limiting, access restrictions, IP blocking, bot detection, and account suspension.

We reserve all rights and remedies available under these Terms, the Data & Commercial Use Policy, and applicable law.

9Intellectual Property

The Service, including PackScout's software, design, text, graphics, logos, original content, EV methodology, proprietary calculations, lexicon, selection and arrangement of information, compiled datasets, rankings, and presentation of information, is owned by PackScout LLC or its licensors, except for third-party information and intellectual property belonging to their respective owners.

Subject to these Terms, PackScout grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for your own non-commercial purposes.

Nothing in these Terms transfers ownership of PackScout intellectual property to you.

PackScout retains all rights available to it under applicable law in its software, methodology, original content, selection, coordination, arrangement, compilation, and presentation of PackScout data and other proprietary materials.

Third-party facts, trademarks, logos, product names, and other third-party materials remain the property of their respective owners.

The Service contains links to and information about Third-Party Platforms that PackScout does not own or control.

PackScout is not responsible for the content, products, availability, accuracy, legality, security, privacy practices, terms, business practices, customer service, shipping, fulfillment, refunds, disputes, or other conduct of a Third-Party Platform.

Your interactions and transactions with a Third-Party Platform are solely between you and that platform.

A link to, ranking of, comparison involving, or display of a Third-Party Platform or its products does not constitute PackScout's guarantee, endorsement, or assumption of responsibility for that platform or product.

You should review the applicable Third-Party Platform's terms, privacy policy, product disclosures, and other relevant information before transacting with it.

11Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE AND ALL CONTENT, CALCULATIONS, DATA, METRICS, RANKINGS, VALUATIONS, ODDS, MATERIALS, AND FEATURES PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

PACKSCOUT DISCLAIMS, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, AND QUIET ENJOYMENT.

We do not warrant that:

  • the Service will be uninterrupted, available, secure, or error-free;
  • any defect or error will be corrected;
  • any data or calculation will be accurate, complete, or current;
  • any Third-Party Platform will honor displayed odds, prices, inventory, terms, or representations;
  • any product will have a particular value or outcome; or
  • your use of information displayed by PackScout will result in any particular financial or economic outcome.

Your use of the Service and reliance on information obtained through it are at your own risk.

12Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACKSCOUT LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS OPPORTUNITY, COLLECTIBLE VALUE, OR OTHER ECONOMIC LOSS, ARISING OUT OF OR RELATING TO THE SERVICE, THESE TERMS, OR ANY THIRD-PARTY PLATFORM OR PRODUCT, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Without limiting the foregoing, PackScout shall not be liable for losses arising out of or relating to:

  • your purchase, opening, sale, holding, or use of any repack, pack, collectible, or other product;
  • reliance on any EV figure, valuation, ranking, odds calculation, price, comparison, confidence indicator, or other PackScout metric;
  • inaccurate, incomplete, delayed, stale, unavailable, or erroneous information;
  • differences between PackScout's methodology or estimates and actual market value or realized outcomes;
  • changes made by a Third-Party Platform;
  • the acts or omissions of any Third-Party Platform; or
  • unauthorized access to or interruption of the Service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PACKSCOUT'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID DIRECTLY TO PACKSCOUT FOR USE OF THE SERVICE DURING THE TWELVE MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Amounts paid by you to a Third-Party Platform are not amounts paid to PackScout for purposes of this limitation.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, the limitations above apply only to the maximum extent permitted by applicable law.

13Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless PackScout LLC and its owners, members, managers, officers, directors, employees, contractors, agents, and affiliates from and against claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:

  • your misuse of the Service;
  • your violation of these Terms or the Data & Commercial Use Policy;
  • your violation of applicable law or the rights of another person or entity; or
  • your unauthorized collection, reproduction, republication, commercial exploitation, or other use of PackScout data or content.

Nothing in this Section requires a consumer to indemnify PackScout to the extent such an obligation is prohibited by applicable law.

14Dispute Resolution; Binding Individual Arbitration; Class Action Waiver

A. Informal Resolution

Before initiating arbitration, you and PackScout agree to attempt to resolve any dispute informally.

A party seeking to initiate a dispute must provide the other party with written notice describing the nature and basis of the claim and the relief sought. Notices to PackScout must be sent to hello@packscout.com.

The parties will attempt in good faith to resolve the dispute for at least 30 days after receipt of the notice before commencing arbitration, except where immediate injunctive relief is reasonably necessary.

B. Agreement to Arbitrate

Except for the exceptions stated below, any dispute, claim, or controversy arising out of or relating to these Terms, the Service, PackScout content or data, or your relationship with PackScout shall be resolved exclusively through final and binding arbitration on an individual basis rather than in court.

The arbitration shall be administered by the American Arbitration Association ("AAA") under the applicable AAA Consumer Arbitration Rules then in effect, except to the extent those rules conflict with these Terms or applicable law.

The arbitrator shall have authority to award the same individual remedies that would otherwise be available in court, subject to the limitations contained in these Terms and applicable law.

C. Exceptions

Either party may bring an individual claim in small claims court if the claim qualifies.

PackScout may also seek temporary, preliminary, or permanent injunctive or equitable relief in a court of competent jurisdiction to prevent or stop unauthorized access to the Service, scraping, misuse of PackScout data, infringement or misappropriation of intellectual property, circumvention of technical restrictions, or other conduct that threatens immediate or irreparable harm to PackScout or the Service.

D. CLASS ACTION AND REPRESENTATIVE ACTION WAIVER

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND PACKSCOUT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, COORDINATED, MASS, OR REPRESENTATIVE ACTION OR PROCEEDING.

THE ARBITRATOR MAY AWARD RELIEF ONLY TO THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO RESOLVE THAT PARTY'S INDIVIDUAL CLAIM.

YOU AND PACKSCOUT EACH WAIVE ANY RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.

E. Severability

If any portion of this Section 14 is found unenforceable, that portion shall be severed or limited to the minimum extent necessary, and the remainder of this Section shall remain in effect to the maximum extent permitted by law.

If applicable law prohibits enforcement of the class or representative action waiver with respect to a particular claim or request for relief, that claim or request for relief shall proceed in a court of competent jurisdiction only after all arbitrable claims have been resolved, to the extent permitted by law.

15Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles, except to the extent superseded by applicable federal law or other law that cannot validly be waived.

16Changes to the Service and These Terms

We may modify, update, suspend, restrict, or discontinue the Service or any part of it at any time.

We may also update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date and, where appropriate or legally required, by providing additional notice.

Your continued use of the Service after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

17Termination

We may suspend, restrict, or terminate your access to the Service if you violate these Terms, misuse the Service, create risk or possible legal exposure for PackScout, or engage in conduct we reasonably believe threatens the Service, PackScout, our users, or third parties.

We otherwise reserve the right to modify or discontinue access to the Service to the extent permitted by applicable law.

You may stop using the Service at any time.

Provisions that by their nature should survive termination, including provisions concerning intellectual property, data restrictions, disclaimers, limitations of liability, indemnification, dispute resolution, and governing law, will survive termination.

18Miscellaneous

These Terms, together with our Privacy Policy, Data & Commercial Use Policy, and any other policies or terms expressly incorporated by reference, constitute the entire agreement between you and PackScout concerning the Service.

If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect, subject to the specific severability provisions in Section 14.

PackScout's failure to enforce any provision of these Terms is not a waiver of its right to do so later.

You may not assign or transfer these Terms or any rights granted under them without PackScout's prior written consent. PackScout may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or by operation of law.

Headings are provided for convenience and do not affect interpretation.
